If a loved one has not effectively established their estate plan, it can cause their assets to have to go through probate. Probate is a legal proceeding in which the Court oversees the distribution of a decedent’s assets. If a person dies with a will, then the Court makes sure that the personal representative (or executor as it is called in other states) complies with the terms of the will and distributes the assets as the decedent indicated in the will. If a person dies without a will, the Court makes sure the personal representative distributes the assets according to Florida Statutes. It can be a difficult time for the loved ones when someone passes away.
